The following store regulations are effective from 01.01.2023.
1. General Information
1.1. The online store, operating at https://donegal.com.pl/ (hereinafter referred to as the Store), is the official online store selling products of Donegal Sp. z o.o. in Rzeszów. The owner of the Store is Donegal Sp. z o.o., ul. Krakowska 154, 35-506 Rzeszów, entered into the Register of Entrepreneurs of the National Court Register by the District Court in Rzeszów, 12th Commercial Division of the National Court Register under number 0000248060, NIP (Tax ID) 8130139781, REGON (Business ID) 690637480, with a share capital of PLN 600,000.00. 1.2. Donegal does not make the website https://donegal.com.pl/ available to third parties, including non-entrepreneurs, for the purpose of offering goods, services, or digital content and concluding contracts.
1.3. Contracts in the Store are concluded between Donegal and the Customer. For matters related to contracts, Donegal can be contacted via e-mail: sklep@donegal.com.pl and by phone: (+48) 17 860 16 30.
1.4. Customers of the Store can be natural persons, legal persons, and organizational units without legal personality to which the law grants legal capacity. A Customer who is a consumer is understood as a natural person performing a legal transaction not directly related to their business or professional activity. The provisions concerning consumers also apply to a Customer who is a natural person conducting a business activity if the contract is not of a professional nature for them.
1.5. The condition for making purchases is the acceptance of these Terms and Conditions and placing an order.
1.6. The Terms and Conditions are an integral part of the sales contract.
1.7. Donegal reserves the right to change the Terms and Conditions. Changes do not apply to orders placed before they come into force. The new regulations are effective from the date of their publication on the Store's website.
1.8. Trademarks used on the site are the property of their owners and have been used for identification purposes only.
1.9. The Terms and Conditions are available at https://donegal.com.pl/ and at the company's headquarters.
1.10. Information on the Store's website does not constitute an offer within the meaning of the Civil Code, but only an invitation to submit offers.
2. Product Offer
2.1. The product offer is valid within the territory of the Republic of Poland.
2.2. Products may be subject to promotions under the terms specified in the promotion conditions. The number of products on promotion is limited.
2.3. Promotions cannot be combined, unless the promotion's terms and conditions state otherwise.
2.4. Free promotional extras are not subject to exchange or complaint.
2.5. All prices are given in Polish zloty (PLN) and include VAT. The price is binding at the time of placing the order.
2.6. Donegal reserves the right to change prices, introduce and withdraw products, and organize and cancel promotions.
2.7. The Store's offer is addressed to Customers with a place of residence or registered office in Poland. The shipping address can be within Europe. A VAT invoice is issued for each order (with no option to issue it to a foreign Customer address).
3. Placing and Accepting Orders
3.1. Orders can be placed in two ways:
- after prior registration,
- without registration (as a "guest").
3.2. Placing an order entails an obligation to pay.
3.3. Registered Customers have access to additional features, such as order history and status tracking.
3.4. Registration requires filling out a form and providing truthful data.
3.5. When placing an order as a "guest", you must provide contact details, invoice information, and shipping details.
3.6. To place an order, you must click the "order with obligation to pay" button.
3.7. The Customer is obliged to provide truthful data.
3.8. Orders can be placed 24/7. The store may be temporarily unavailable due to maintenance.
3.9. After placing an order, the Customer receives an automatic confirmation to the provided e-mail address.
3.10. The order is then verified. The Customer receives information about the acceptance of the order for processing (except for online payments).
3.11. The sales contract is concluded when the Customer receives information about the acceptance of the order for processing (or upon completion of placing the order for online payments).
3.12. After concluding the contract, Donegal sends the Customer a confirmation containing order details, the regulations in PDF format, and information on the right to withdraw from the contract.
3.13. Donegal may refuse to accept an order for justified reasons (e.g., lack of product, system error, false data, delivery address outside of Europe).
3.14. The Customer can cancel or modify the order until receiving information about its shipment.
3.15. Orders are processed on business days from Monday to Friday between 8:00 AM and 4:00 PM.
4. Payment Rules
4.1. Available payment methods:
- Cash on delivery,
- Bank transfer,
- Via an online payment system.

4.3. For bank transfers, the Customer has 7 business days to make the payment.
5. Delivery of Goods
5.1. Donegal is obliged to deliver goods that conform to the contract.
5.2. Delivery is carried out within Poland and other European countries via FedEx courier service.
5.3. Delivery costs are added to the order value.
5.4. Fee schedule:
- Personal pickup at Donegal headquarters – PLN 0,
- Pickup at Orlen Paczka point - PLN 10.99 (bank transfer),
- FedEx courier - PLN 16.99 (bank transfer),
- FedEx courier - PLN 18.99 (cash on delivery),
- Pickup at InPost point - PLN 15.99 (bank transfer),
- Free delivery to an Orlen Paczka point for orders over PLN 50 (bank transfer).
5.5. Order processing time: orders placed by 10:00 AM are shipped the same business day. Delivery time is 1-2 business days.
5.6. The delivery time outside of Poland is determined individually, but no longer than 30 days from the conclusion of the contract.
5.7. During pre-holiday periods, the processing time may be extended, and Customers will be informed.
5.8. In case of inability to deliver the ordered goods, Donegal may offer a substitute product.
6. Right of Withdrawal
6.1. The right of withdrawal applies to consumers and natural persons conducting a business activity to whom consumer regulations apply.
6.2. You have the right to withdraw from the contract within 14 days without giving any reason.
6.3. The withdrawal period expires 14 days after the day you acquire possession of the goods.
6.4. To exercise the right of withdrawal, you must inform Donegal of your decision by a clear statement (e.g., a letter sent by post or e-mail).
6.5. You may use the model withdrawal form available on the Store's website.
6.6. It is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
6.7. The model withdrawal form is available at https://donegal.com.pl/.
6.8. The right of withdrawal does not apply to goods supplied in a sealed package which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
7. Effects of Withdrawal
7.1. If you withdraw from the contract, we will reimburse to you all payments received from you (including the costs of delivery, except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than 14 days from the day on which we are informed about your decision.
7.2. You shall send back the goods to the address: Donegal Sp. z o.o., ul. Krakowska 154, 35-506 Rzeszów, Poland, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us.
7.3. You will have to bear the direct cost of returning the goods.
7.4. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
8. Seller's Liability, Complaints
8.1. Donegal is liable for the lack of conformity of the goods with the contract under the terms of the Consumer Rights Act.
8.2. The Customer should check the contents of the shipment in the presence of the courier.
8.3. Complaints can be submitted by phone (+48) 17 854 19 98, e-mail: reklamacje@donegal.com.pl, or in writing to the company's headquarters.
8.4. Complaints are processed within 14 days.
8.5. Liability under warranty is regulated by the Civil Code.
8.6. Donegal's liability under warranty does not exclude liability for non-performance or improper performance of the contract.
9. Customer's Personal Data
9.1. The administrator of personal data is Donegal Sp. z o.o. with its registered office in Rzeszów.
9.2. Personal data is processed for the purpose of executing the contract and for marketing purposes (with the Customer's consent).
9.3. Providing data is voluntary but necessary to process the order.
9.4. Providing data for marketing purposes is voluntary.
9.5. The basis for data processing is the contract and the Customer's consent.
9.6. Authorized employees and associates of Donegal have access to the data.
9.7. Data may be shared with third parties to execute the contract (e.g., courier companies).
9.8. Data is stored for the period necessary to execute the contract and pursue claims.
9.9. The Customer has the right to access, rectify, delete, or limit the processing of their data.
9.10. The Customer can withdraw consent for the processing of data for marketing purposes at any time.
9.11. The Customer has the right to lodge a complaint with the President of the Personal Data Protection Office.
10. Final Provisions
10.1. Disputes will be resolved amicably.
10.2. In the absence of an agreement, disputes with Customers who are not consumers will be resolved by the court competent for the registered office of Donegal.
